22 years ago during divorce, the court retained jurisdiction over each parties retirement/pension for division based on number of years of marriage in ratio to number of years of retirement. we were married 19 years. ex spouse has now filed motion for judgement since I have retired after 37 years with civil service pension. she has not reached retirement age but was fully vested in social security during the marriage.
do I have any recourse other than having a standard formula applied to determine the percentage that she is entitled to?
Can her future social security benefits be considered as an off-set when determining percentage?
