My husband's ex-wife has just filed a petition to increase child support. He currently pays support on his first child who is 18 and graduates from high school next month. We do not know if this child will be attending college or if he will be responsible for that.
We told the ex that we would begin giving her the additional 32% (he has 3 children from this marriage) as soon as she graduated. This was not good enough. The ex wife wants more money. I guess my question is, will the judge take into account current living situation of both custodial and non-custodial parents? We have filed bankruptcy in the last 6 months and have very few assets. He is in contruction and his income varies. For several years he only made $60K but last year made $87K. This was an extremely abnormal year and he is on his way to another $60K year. She has just begun a new job with a pay increase, lives in a brand new home, and has been on vacation 3 times since October. I feel that we are paying to support her life style and we can't make ends meet.
