This post is in reference to my grandmother. She lives in Texas but received the medical care in Louisiana. She was prescribed a medication that caused retinal bleeding and loss of vision in one eye. The medication was prescribed for a kidney condition and the prescribing physician apparently did not perform the necessary followup or exams to detect/prevent. She consulted an opthamologist about the loss of vision in 03-2002. Has the statute of limitations expired?

Louisiana's Statute of Limitations: Medical Malpractice Actions: Actions against health-care providers must be filed within one year of the date that the act giving rise to the injury occurred, or one year from the date that the plaintiff discovers the injury. In no event can a medical malpractice action be filed more than three years from the date that the act giving rise to the injury occurred.

No. Attorneys are able to gain extended lengths of time for various reasons. Other than damages from an act of negligence that was not discoverable during the one year time period, I really have no idea.
