What is the name of your state? GEORGIA

Is it true that according to The Family Educational Rights and Privacy act (FERPA), Public Law 93-380, Title 20, USCA Section 1232(g), et. seq. and Title 93-568 et seq., both the CP and the NCP are entitled to copies of their child(rens) school records? And if so, what is/are the remedies for those NCP's who are denied these records?

Georgia Staute 20-2-720.

No local school system, whether county, independent, or area, shall
have a policy of denying, or which effectively prevents, the parents
of students who are in attendance at or who have been enrolled in
any facility within such system the right to inspect and review the
education records of their children.

A parent shall be entitled to
inspect and review only information relating to his or her own child
and if any material or document in a child's record includes
information on another student, such information regarding any other
student shall not be made available for inspection or review except
to the parents of that student. Both parents of a child shall be
entitled to inspect and review the educational records of their
child or to be provided information concerning their child's
progress.

Information concerning a child's education record shall
not be withheld from the noncustodial parent unless a court order
has specifically removed the right of the noncustodial parent to
such information or unless parental rights have been terminated.


Simply put, if you are denied access to the records of your child upon providing the proof necessary to establish your right, then you need to file a civil suit against the school, it's custodian of records (usually the principle and/or the school board) and force them to release the records.

One issue I note , is you are stating " copies of records ".

If you live close by , you may be entitled to set up an appointment to go in and review the records.
In this scenario, they would not be required to send you copies.

Usually if you live any distance from the school , and it would make it difficult to travel to the school, then you should be entitled to copies , of relevant school records, but not all .

Again include in your request , I am a Parent of ( name of child ) and HAVE NO
Court order baring me from my child's records.As such under Federal Law I am entitled to review or obtain records if I can not travel .
Here is the proof that I am A Parent . Attach a copy .
