What is the name of your state? mo

My son just received an MIP - he was not driving a vehicle. He has never had any citations of any kind prior to this- not even a speeding ticket. Should we retain an attorney before he goes to court or will it really make a difference in his sentence? He admitted to the arresting officers that the beer was his. What is the likely sentence? We are less concerned with the amount of the fine, but worried about any possible jail time which if I read the statute correctly could be up to one year.
