What is the name of your state? MAINE & MASSACHUSETTS

My mom passed away several weeks ago. I am the executor of her will. All bank accounts were in her name and my name, payable to me after her death. Nothing went to Probate. She owned no property except a one year old car. She verbally stated that my brother could have her car after she died. This is not a problem.

My question is he lives in Massachusetts, she lived in Maine. I contacted the Massachusetts RMV and they stated as follow:

QUOTE

If a decedent has left a will, the executor of the decedent's estate may
transfer the title with the following documents:

* A copy of the Appointment of Executor
* Decedent's Certificate of Title assigned by Executor

END OF QUOTE

What is an Appointment of Executor and does this mean the car has to go to PROBATE COURT in Maine? If so, will I need a lawyer for this transaction?

Thank you and feel free to email me directly at [email protected]
