12 year old male raped by a 16 year old male while both were in a court ordered
youth residential home. 16 year old will be 17 in three weeks. Is this considered
statutory rape and, can 16 year old be charged as an adult? I know for sure 12
year old is under the age of consent. States attorneys office says it is consensual on the part of 12 year old as he sneeked out of his window and went to room of 16 year old and 16 year old has yet to be arrested.
They were caught by the youth facility staff during this incident.
12 year old was denied medical attention until 5 days after alleged assault
and department of Child And Family Services was never called even though
the facility has guardianship and are mandated reporters. 12 year old has
told police of the incident in detail and the grooming done by 16 year old leading up to the assault. 16 year old denies it happened. The staff is now covering their tracks for fear of losing their jobs and DCFS happens to be the
licensor of the facility. States attorney happens to be advisor to the juvinile court services that placed these children and all of the who's who in the area are on the board of directors of facility. Everyone involved has tried to sweep the matter under the rug. Any suggestions on how to proceed would be appreciated. Thank You!

Illinois
States attorneys office is stalling to make arrest for some unknown reason.
Investigator from sheriffs office has told us he has enough to arrest 17 year old
and just waiting on word from States attorneys office but still no arrest.
What type of lawyer do I need? Will an attorney assist us in making sure this
perp is arrested. Where can we go if States attorney won't make arrest?
Who supervises states attorneys office?
Any help at all would be appreciated!

There is much left out since we can't hear or see what actually happened. However if the 12yr boy did crawl out his window and goto the room of the 16yr old then that might be consent on his part. However there should have been better monitoring in the facility.

I would contact a lawyer handeling cases of this nature.
