Am being sued by a tree service company for remaining payment for work that they did not complete, which will initially go to mediation.
Went to file counterclaim against them for costs to finish job, but they have registered as a corporation since the work was done - but thier suit does not list them as a corporation.
Was told I had to have EXACT name for who I was filing counterclaim against.
As the work was done prior to their filing suit and their beoming a corporation, do I file against them as a private company and individual - PLUS naming them as a corporation as a defendent in the counterclaim?
