What is the name of your state?What is the name of your state?Indiana. My father in law is in the hospital and is going to die.He did not have a will.Everything they have and own is in both of their names even all the bank accounts. Will everything automatically go to my mother in law?And does it go threw probate for along time?

The term "both names were on the property" can have many different meanings as it depends exactly HOW the names were on the property.

If all the assets were held in "joint tenancy" or "tenancy by the entirety" the assets would pass to her by operation of law and without probate. If held as tenants in commn that's a different story.

BUT make sure she has a will prepared now.
