What is the name of your state? What is the name of your state? california

I found a .jpg (of a Degas sculpture) online that I'd like to use as my CD cover art. I emailed the photographer twice, asking permission, and haven't heard back. I really like the .jpg. Should I use it anyway? Or is the risk too great that he might sue? Thanks! -Bob
