I'm currently going through a divorce and it looks like the 6 month waiting period is going to be over around October, 2004. My wife and I separated August 2003 and she has been living away from home since then. The divorce papers were filed and responded back in early April 2004. I am planning to buy her out of the house and refinance. My question is that since she has been living away from home and I've been making all the payments to include the property taxes and house insurance where does the law draw the line up to when she can reap the benefit of the appreciation of the house?
