Is it possible to sue the US Post Office in
small claims court?

I have an internet business I run from the house.
I ship everything USPS COD (collect on delivery)
I do this because because of the amount of credit card
fraud and bad checks I received in the past.
When I neither receive the funds or the package back
(unclaimed or refused) I file an insurance claim with
the Post Office. For 2003 I have 117 claims (about $4000)
that have not been processed. They are now 7 to 19 months old.
I sat down with the lady that handles the claims and her supervisor
at the local Post Office 103 days ago and still nothing has progessed.
I was told the original person who handled claims went on maternity
leave for 8 months and the gentlemen that took her place only
worked for 2 weeks before taking leave for back susgery.

Is the Federal Claim for Damages the correct way to proceed?

My response:

No. The P.O. is an agency of the Federal Government, not the State Government. In order to sue the P.O., you need to serve them with a Federal Claim for Damages, which has a two-year Statute of Limitations. Then, when they deny the claim, then you get to sue the P.O. in Federal Court.
