What are the consequences of an Air Force Officer marrying an illegal alien? This Officer is currently a top secret investigation clearance pending a status. Could future possible security clearance jeopardise his career as an officer?
Can JAG help this officer on getting his fiance in the US legal to get married without doing a Fiance (K-1) visa and having to wait a year or more for approval?

JAG is simply there for military matters, and has no jurisdiction in Civil matters. You can marry who ever you want, but you will never be able to transfer her, or live on any installlation with her. Your clearance will definitely be jeopardised. You need to follow the immigration laws in order to marry her and get her legal.

Repost this in the immigration forum. It's pretty difficult, if not impossible, to obtain legal U.S. Citizenship if you are currently in the country illegally. Again, report this on the immigration forum, they'll be able to give you a definitive answer.

His clearance will be delayed; I married a foreign national while on active duty after I had a clearance and had to get a waiver as they invested her background. It takes sometime but within a year I was taken off of the waiver.

Once he's married he'll have to go through INS...and this can take quite a long time. As for overseas duties, she can go with him, but they will have to stay out in the economy...But she will have access to base facilities.

A quick way around most of these problems is to just send the illegal back to country of origin and they marry there...Then it's just marrying a foreign national.

If you (HE) knowingly marries an illegal immigrant, you will lose your clearance and will jeopardize your career status. The JAG can't help you. They can advise, but can't help. As an Officer, this should have been explained to you in OCS (Maybe not the specifics, but the general information).

Do NOT try to circumvent the process. Be patient. Send her home, apply for marriage license, bring her into the military family with all the required paperwork and the rest of your career will go MUCH, MUCH smoother.
