My boyfriend has been divorced for two years. At the time of his divorce, he assumed both of "their" two children were his biological children. One child is certainly their biological child. It is probable that the second child is NOT his. He has been paying child support for both.
He is considering DNA tests to confirm paternity (or lack thereof). If DNA testing proves that he is NOT the father of the second child, what recourse does he have? His then wife told him that the child is his. Is he stuck paying for that child? Can he ask that the money paid out to her for that child be refunded?
The ex probably knows whether he is the father or not. Is there a civil penalty we can seek if she did lie about the paternity of this child?
