:confused: What is the name of your state? California
Have a friend who needs some advice on what is the best choice? He talked to an attorney about a drug case he has pending or should I say it has turned into a bench warrent.He got arrested possession of drugs, got prop 36 which means that he has to do classes drug testing etc... well he didi'nt so what I was wondering would it be better to have an attorney and go to back to court and see what happens OR just turn himself in and receive jail time. Also when you do jail time are you just put on probation or what happens???

If he failed to comply last time, its possible that he will no longer be eligible for Prop. 36 (depending on the circumstances).

However, he will likely have to do a short time for the FTA, but likely allowed to do drug court or prop. 36 for the underlying drug offense.
