Hi,

Here is the situation.

I live on a flag lot and the house in front of mine is a rental. Our drive way is very long and on the side of our driveway( through our actual security gate) is an access side driveway to the back of the front house. When we bought the house ( the back house) it was implied, but not stated that the owners of the front house has limited access to the side gate for parking vehicles. Lately it has been used on a weekly basis and we want to contest it's usage. The actual zoning of our house states that they have 3ft of access usage on the side of our driveway. The owner of the front house says they have a variance that allows usage. Their is a guest house in the back of the front house with a car port and driveway. This house is zoned for R1-1 single housing unit. Is it legal to have a guest house on R1-1 zoning.

What would be the Price on clearing up this dispute and getting it written on the property papers of eliminating access. Either stating no access or very limited access by owners permission. If the front house is sold we are afraid that the new owners will use it for daily access. We cannot go through our drive way when they have that gate open. Trespassing issues as well as privacy issues are the concerns.
