What is the name of your state?CA
If our 2 children have always been in private school, can they stay there when we divorce and the ruling would be that both parents pay half of tuition. Or does one parent have a say in this and refuse to pay? . Can the court order also future funds for college tuition? :rolleyes:

Generally, if the parents had agreed prior to divorcing that the kids should go to private school - a court is going to continue that. They just don't like to see one parent decide unilaterally to send a kid to a pricey school and then expect the other parent to fund it.

As for college..... that's more tricky. A college education isn't a right, and courts are leery of ordering divorced parents to pay for college (married parents aren't required to). That one's a crapshoot unless the parents agree to it.

The court may order college support, but in CA, support ends when the child has turned 18 and has graduated high school, but no longer than age 19. If both parties are in agreement, maybe, but if not then it's up to a judge.
