can any legal action be taken against someone who used my atm card, somehow they knew the pin number??

My response:

No. The presumption will be, and the defense will be, that you gave the person your PIN. You could deny it all day and night long, but it's the "presumption" that will get you.

How did they get your ATM card and PIN? Did you know the person?

If the person were a complete stranger, you might stand a chance for a conviction. If it were an acquaintance or a friend - particularly someone who has used the card before - prosecution is not very likely.
