Is there a time limit for filing a malpractice lawsuit. For instance, my son was injured several years ago (twice). On both occassions I took him to a dr. who insisted there was nothing serious wrong. Just a bruised foot. The second time I insisted on a second opinion after waitng for about six months for his "bruised foot" to heal. He just got worse.

The specialist said his foot had been broken both times and that due to the fact that his foot was not set and he walked on it for over a year by twisting his foot sideways and walking on his heel, he has nerve and tendon damage which cannot be corrected. He will be in pain for the rest of his life. The son was 18 at the time. He turned 19 and my insurance no longer covered his treatment, so he just quit going to the Dr.

He got pretty depressed at the idea of never getting better and kind of zoned out for a few years. He really needs to be on disbility, but I don't know how to do that, but can he sue for malpractice this late in the game?

I don't know why I didn't do it before, but I didn't.
