What is the name of your state?FL
Was sued by person (A) and her small company (B) to collect on work never performed.
I counter sued (A) and the company (B) as I found A's name as the owner on occupational license. I also asked the clerk to include another person's (C)name who was shown as an owner when I researched my state corporation records prior to filing my counter claim. Clerk said I could only include A and B on my counter claim as they were only names listed in their orginal suit, but could not include C, even though I showed clerk proof of C's name being listed as owenr from state records.
Went to court, she (A) never showed, and got dismissal plus judgement against her (A) and company (B) for my coutner claim.
In my research to collect judgement, appears everything is in the name of C.
Can I present judge my original counterclaim paperwork which includes C, and ask that the judegment include C?

No, because it's a COUNTER claim, not an original suit. However, you still have a judgement against the company. RIGHT? Does that give you a hint?

Yes, I do have that claim, however any assets I have found UCC filings on, are soley in the name of party C, not the company.
Where do I get my next hint?

You have a judgement against the company. After the allotted waiting time for the company and the individual to satisfy the judgement you can either file a judgement lien against the company and/or the individual OR contact a judgement recovery specialist and turn it over to them.

Even a corporation is not immune to collections.

Thanks.... and as you mentione corporation... here is another interesting twist.
Just prior to filing thier suit (which they did on 5/22) based on the problem having occurred earlier in the month, I have found out that they incorporated on 5/18 - so then I was wondering if they shuttled any company asets into the corporation to keep them away prior to filing their original suit.
Guess I'll have to wait and see what a specialist advises.
