How do we get the kids back?

My brother-in-law is in the process of getting a divorce. Meanwhile, his wife left and took the kids with her back to her "home" state. How do we get the kids back to him in Illinois? Are there any legal matters involved here?

Tell your brother IMMEDIASTELY file for divorce and ask for custody before his wife establishes six months of residence or one year of residence in other state, forcing her to come back with the kids....then it will be up to the judge to decide what to do....But do it right now before the wife files for the custody or divorce in other state, forcing your brother to go to that state on numerous times.

While I agree that the BIL should immediately file for divorce, this action in and of itself will do nothing to bring the children back. The ONLY person affected by the filing will be the wife.

Until a judge rules in favor of sole custody for the husband, the children will not be ordered back to the state. The mother, as well as the father, until the divorce and adjudication of custody, have equal rights to the children.
