What is the name of your state?MA- mother residing in a nursing home in RI(3mos)- estate plan originated in Florida ( legaln residence)
executor is on of 3 brothers - he is personally in severe financial trouble due to a court judgement of $2,000,000.00 for corporate theft.Father told brothers that his estate was worth X and that is was to be divided 3 ways, executor now says that it is worth 1/3 X - financial institutions in Florida that held assets will not reveal where assets have gone, say that assets were there, have been moved - see family - what are the rights of other brothers??? Mother is in nursing home and has been declared incompetant although she is cognisant of all things said in her presence and we suspect that her agreement to will and trust is fraudulent. Where do we begin? - any help is most sincerely apreciated.

If father is not alive, then what year did he die?

This executor, due to his criminal record, might be disqualified to serve as such. Yes, you do need to be consulting with a probate attorney to figure out your best options.
