I live in NY. Is it illegal for someone to access your email account by figuring out your password and sending private emails from your folders to other people? If so, what recourse would one have to prosecute the person stealing their emails?

Unless they broke into your house, there is probably not a whole lot you can do accept for changing your e-mail password. Unless you were somehow seriously harmed or suffered a loss due to the e-mails, I doubt that anyone is going to spend any amount of time looking into what a family member, roommate, or co-worker did with your e-mail. And even then, it may be civil as opposed to criminal.

If we went after every person who had someone send e-mail on their acount, we'd have to add a lot more cops!
