What is the name of your state?texas my ex is on ss disability.can i still file for back cs?paternity is established,the child is 18 years old,and i am the custodial parent.my son received benifits of $189 a month from 2000 till he turned 18 in may of 2004.my ex was ordered to pay $300 mon. in 1988.he never paid any of it.what are my options?

SSI from the State or SSDI from working ?

If it was SSDI you child should have received some benifit already from your husband's DI.

If he receives State SSI , no one can touch it anyways. It's for his care, although some State's have a minumum, $25.00 here reguardless of little or no income.

the ss is from work i would imagine.i know he will never work again.and yes my son recieved the benefits as listed in last post.even still there wasn'tany cs from may of "86 to june "96.

Why are you know ,when your son is 18 , bringing this up ?

This matter should have been brought to the attention of the Court at least within 6 months , if not sooner after not receiving payment.

You really think it's now fair Of you to want him to pay now After you child turned 18 , and after he is now disabled permanently ?

Anyways , SSDI is exempt seizer from child support payment and arrears .
