My husband and I purchased our home from a family trust, represented by one of the family members who signed all the documents and used her SSN when forms asked for Seller's SSN. We may have to sue for breach of contract if our agent's broker is not able to resolve the issues. Do we sue the individual, or the family trust? Specifically, her documents always listed the seller as the XXX Family Trust, with her name as signer and her SSN. The total amount of damages is less than $10,000 so we would most likely file pro se in district court, which has a $10K cap for pro se filings.
