My husband sold his Rolex watch that had been listed on Ebay but was taken off the site and sold privately to a customer who had seen it on the site. The watch was sold to this person in New York for the agreed price of $4,200.00. Arrangements was made to ship him the watch through UPS/COD and was insured for that amount with UPS. The UPS driver took a cashier check from this man for the amount of the watch, forwarded this check to us 2 1/2 weeks later. We deposited the check and our bank returned it to us today and debited our account for the money. The reason marked for return was "no account". We only had the last hour of business day to begin checking into this, starting with UPS and the COD issue and will begin again on Monday. Please, please give your advice on how to handle this. The dispatcher at the sheriff's office told me that this will be a felony offense since it is an out of state check and to go to the Magistrate's office on Monday. The buyer in New York has not responded to email.

You can say bye-bye to the watch and money. The USPS did their part, they cannot be held liable. Your only option is to go sue the buyer in New York. You can call and report this to every cop in Georgia, none of them have any legal authority over the buyer in New York. There was a reason the buyer wanted to purchase the watch the way he did and that was to rip you off. I would have smelled that one a mile away, you and your husband were the perfect rubes. Now that you have learned a very expensive lesson about selling on eBay, remember rule #1: Never, never, never, and once again, never send any merchandise until you have cash (you know, the green stuff with dead presidents on it) in hand or the funds have been credited to your very own safe and secure bank account. And because this transaction took place outside of eBay, what little protection they offered is also gone. You and your husband will have to change your names too, yours to Lolly and your hubby's to Pop. You have been suckered big time.

I also believe the OP might of also violated eBay's rules when they sell the watch to someone who saw it on the site. Esp if they cancelled the bidding process or did not fulfill order for the highest bidder if there was one.

The OP did voilate eBay's TOS, but that pales in comparison to the amount of money/merchandise they are out :(


kathybeaty ... you were scammed and since the sale was off eBay you cannot even verify the "buyer's" contact info through eBay's site. It could have been a false name etc ...


Follow up as you were told and hope for the best.
