My aunt recently passed away after a long battle with cancer. She set things up before her death so that everything would be divided equally among her four children. The problem is that one of her daughters is holding out on signing the papers. There is apparently some stipulation that all four children need to sign before the assets (including a home) can be sold and the money distributed. This woman has a history of mental instability, drug abuse, and sometimes will even disappear for weeks at a time. In the meantime, they've had people interested in the house but can't proceed with selling it until she signs off. Is there anything that can be done? The other children do not want to deny her the portion she is entitled to...they just want to get it done so they can move on. They are doing all of the upkeep on the home, paying utility and insurance bills for the home, etc. They have even considered trying to declare her incompetent.
