My divorce decree says I must pay permanent spousal support. It also says that the devided marital assets (54% of assets at time of 1992 divorce) are to be set aside to fund spouses retirement. She did not do this and is now seeking a further lump sum payment to fund an annunity.
I set my 46% aside, retired at the normal time and would like to stay retired. The attorneys tell me that because my ex has spent everything that was to be set aside for her retirement, I will still be responsible for permanent support because "I can afford it".
I am really frustrated with this situation and need some advice on alternatives to Minnesota law.
