Mr 12 yr old stepon has down. We have had 10 yrs of abusive and erratic behaviour from Mom who has joint and physical custody. Constant hostility and interference with visitation eo weekend and eo Wed. Now child understands situation and is being disturbed by mothers behaviors - calling police to fathers house - not allowing child to phone father. Very concerned that this is now affecting childs emotional state. School called today saying that he was very upset by what happened last night. Mother is also suing school district re education issues. This is last straw we need to do something. Can't afford attorney. Divorce cost over $25K due to Sex abuse allegations etc made by mother. Believe she sees child as meal ticket and uses him in her anger against father. Has told us he was beaten and sent to bed without food. I believe she is not mentally stable and am worried that things will really unravel soon. We live in NJ. What are chances we can change custody agreement. Child is high functioning, very articulate and very intimidated by Mom. His comment " she doesnt think right sometimes".

Without an attorney.. silm.. unless you have some arse rocking evidence that is going to blow the judge out of his pants.

Tks for your response. what kind of evidence do we need. We are now keeping a log. Could the school officials give evidence. Can the child be talked to if necessary. What about the chances of modifying the custody agreement to 50/50 physical. Does the fact that the child is disabled make the case that much more difficult. He is now at the stage where he simply adores his dad and I beliee mom is insecure about this also. We have never badmouthed his mom and have always tried to make him understand he is entitled to time with both parents. He is aware that Mom doesnt like him to be with dad. Has anyone had experience in NJ with diabled kids and this kind of situation. Tks for your help.
