I work for a dentist and we are using an outside collection agency. On our registration forms in the office, we have all patients sign a patient information form and it has a statement stating that a fee will be charged if they are sent to collections.

The collections agency states it is illegal for me to do this and when it goes to small claims court it cannot be added to the case. She states that is has to be a set amount, not a percentage. I really do not think she knows what she is talking about.


What is the correct way of doing these procedures?
