My husband has 2 children from his previous marriage. She is remarried to a man that she has been with for many years. The children consider thier stepdad as a dad and he wants to adopt them, but my husband, thier biological father does not want this, he pays child support and sees them when he is in Buffalo. What are his legal rights and does he need a lawyer to make sure this doesn't happen. Also ex-wife says it's what the children want. Thank you for your time

He does not have to do anything.. they can not be adopted under the circumstances you detail.
