Ok heres the problem my parents both died in March of this year both had wills but because they passed within 10 days of eachother and my dad passed first leaving everything to my mom and leaving her as his only benifishery on his life insuranceand leaving me as his personal rep. we were told that everything had to be taken into probate so for the last 4 months we have been dealing with that it's almost setteled but now the company that my dad worked for is saying that they don't have to pay death benifits to my brother or I because my mom also died and we are not intitled to them! is this true?????

The death benefits due your mother became an asset of her estate.

Why, oh why are you not dealing with a probate attorney?

I am dealing with a probate lawyer but everything is so hazy that I don't know what to do anymore. What I'm saying is that the company is willing to pay the life insurance but won't pay survivor benifits because my mom died.

Then you need to be asking your probate attorney for an explanation.

Or, at the least, get a copy of the policy from the company. If need be, hire a separate attorney to look into it.

We can't get a copy of the policy nor do we have access to read it and offer an opinion.
