I'm asking for a friend. She and her husband filed for divorce a few months ago. The husband just died. The divorce has not been finalized. Is the wife entitled to the 30% elective share as a legal spouse? Her divorce attorney doesn't know. Any advice is greatly appreciated!!!

With a matter of such importance financially with the outcome, she needs to be consulting a probate lawyer herself. Since she is not officially divorced then she probably will qualify to receive the elective share.

She is the wife, and will receive the statutorily mandated share for a spouse.

Easy.

And tell her to fire this idiot.
