Old driveway on neighboors property

What is the name of your state? Virginia
Our home has a driveway that was built about 20 years ago that crosses onto our neighboors property about 1 foot by 12 feet. We recently had the driveway repaved and the next day the neighboor came over and laid a string line across his property line showing us that we had used part of his land. He now wants us to take up this piece. We bought the house 3 years ago and nothing was ever said about the existing driveway. Can we do anything about this or do we have to have it cut out?

I doubt that he would sign an encroachment agreement. He seems determined to have it taken up. Does the fact that there was a driveway in the same spot that we went over have any bearring, even though it was on his property?

If you were spending the money to put in a new driveway, why not make sure you did it right? Just because a prior owner of your home screwed up and encroached on his land doen't mean he has to put up with you doing so all over again with a new driveway.
