What is the name of your state? Vermont

Hi,

Is it legal to record a live concert off the radio and
give away copies of it at no charge?

ex. as a free bonus with something I am selling on ebay.
The offer would clearly state that the tape is absolutely free.

Not sure of the laws?

WHAT IS NOT PROTECTED BY COPYRIGHT?

Works that have not been fixed in a tangible form of expression (for example, choreographic works that have not been notated or recorded, or improvisational speeches or performances that have not been written or recorded)


But... you cannot put it on ebay since the song itself (or another recording of it) is copyright protected. You would not have permission to record it yourself. Putting your own recording (even a first-hand recording) on ebay would get you into all sorts of trouble. :(
