Can a company do a background check of any kind on a potential hire without their premission? Example, calling past and preset employers.

Yes. Your permission is not necessary for an employer to contact your past employers. It is, however, very bad form to contact an applicant's present employer without permission (as there can be negative consequences to the applicant from their current employer) but it's not unlawful.
