What is the name of your state? New York

This is a strange situation and I am not sure how to handle this. Here is the situation:

A person was a passenger in his own vehicle which was being driven by a friend, not a relative. There is an accident. The passenger/owner is seriously injured. The driver does not have insurance. Can the passenger/owner make a claim against his own insurance company (ie: sue himself as owner of the vehicle)????

Please advise
