My employer tells me that if I take advantage of their Education Assistance program, when it comes time for performance reviews, I should expect to receive lower than normal pay increases. Their justification is that both come out of the same departmental budgets.

Is this legal? It seems a little fishy to me.

Yes it is legal.

I also live in Michigan and have an employer that does that exact same practice. I am willing to bet you work in the IT industry too.

Your employer doesn't have to give you a pay raise in the first place. If they wish to consider the tution income monies you receive from them in determining future pay adjustments, they may.
