What is the name of your state?WV. I'm trying to help my brother. My sister-in-law will not give my brother a divorce. Story: They been today 14 yr and married 4 of those. About 6 yr ago my brother (R) took pictures of his 16YO step-daughter (L) while she had just a towel on and was asleep on the sofa. He repeatedly told his wife (B) she shouldn't let L walk around like that, even in front of boys that came over. No response. Six mo later he took pics again. All pics he put on his local computer. Never sold, posted, printed, or abused her. Yes, he did wrong. B found the pics on his computer and was obviously upset. She never prosecuted him but she uses that against him, abuses him and when he threatens to leave, she threatens to prosecute. I have seen pics of his injuries where she hit him, etc. Because of his position in LE and the pics he is afraid of her. He left her 3 mo ago and says he wants a divorce but she still uses the porn. L is pregnant (2x in 2 yr, lost the 1st), and B lets the boyfriend live there. R realizes he did very wrong. He wants a divorce. He told her he wasn't coming back and she said she called the state police on him. He feels there is no use going to an attorney since she has a relative that is a prosecuter. Please advise. :mad:

My response:

I rather doubt this is the whole story, and that the pictures are as "innocent" as you describe - - why else would he put them on his computer? Oh, please, you Country Bumpkins in West Virginia are known for this type of crap anyway - - that, and pure incest.

Was the child 16 six years ago when he took the first pictures or 10 years old? Was she clad in a towel asleep on the couch in a common area of the house, was anything exposed? Was the picture taken to show that the daughter should be more modest? Was anything done about that.

The age of consent in WV is 16, but cannot consent if asleep, also living with the boyfriend is allowed because she is over 16. He should consult with an attorney, it really depends on what the pictures show or don't show and whether or not she was asleep. Does he have access to both the pictures and the computer? Does his wife?

**Have you seen the pictures? If so does he have anything to be worried about?

I have never posted here before so be patient with me.

L was 16 at the time the pics were taken. If R would say anything to B about the way she dressed, B would get very angry. "Don't say anything about her daughter, ever" (her words). I have not seen the pics but my brother said L's private parts were exposed while she was asleep on the sofa. When B found the pics she printed them and has never reported him to anyone. R does not have any pics, and she removed them from his computer. They weren't married at the time, but did 1 yr after this. B calls him a pedophile and when they have fights, she calls people he knows and tells them along with other lies. He never touched L and B never had any problems with L being with him after this happened either. My feelings are if R is such a pedophile, why does B want to stay married. Why didn't she report him then. One minute B says she's filing, the next she wants them to work on their problems. B is very vindictive and is always right. That's why I don't like to talk to her either. R just recently told me about the pics since he wants out and her threats. R is my only sibling and I want to help him.

Will that cure you of the urge, otherwise we will have to dig up a copy of "Clockwork Orange" duct tape you to your chair and force you to watch, and when you cry for mercy we will force you to watch, "Barney and Friends" :D
