HELP!!!!! A MN Emancipation Issue

hi, we live in minnesota and my husband has a 17 year old son that he is currently paying support for. the problem is that the child has not been in the mother's home for most of the past two years. when he is not locked up in a county or state facility he has been on the run or staying with other family members. i have searched the mn statutes and have found very little on the rights of the obligor regarding this issue. he is now being sent to a boot camp in pennsylvania, meanwhile mom keeps collecting support. what can we do?

Petition in court to have modification of child support due to change in circumstances.
Have child emanciapted this requires both parents signatures.
Have child declared incorrigable.
Wait for him to turn 18 and not stay in school.

It is unlikely this child will be emancipated - that requires not only parental consent, but also proof that the child is self-sufficient.

Oh, and it's likely that both Mom and Dad will be paying the boot camp fees. The taxpayers sure as hell don't want to pay them.

:D Thanks for taking the time to respond to my question. We are already planning to file a motion in Family Court and the referee DID tell my husband to come back when his son was 17 to see about the emancipation issue.

Paying his child support payments to the boot camp is not an issue. But it seems mom is never held accountable for her responsibilities. It gets old knowing that the child support is going for her frequent trips to the casino and bingo halls :mad:

We'll be filing papers next week, I imagine the court date will be at least three months out, but I'll let you know what happens at that time
