What is the name of your state? Illinois if a police report states that car number one is at fault how can their insurance company claim that my husband in car number two is at fault. and why should we have to pay the kid who hit us. the officer claimed that car number one was at fault for failure to reduce speed to avoid an accident? :confused:

Some possible reasons: it's their insurance company (by "their", you mean the owner/driver of the other vehicle?); the police report is based on hearsay; the officer drew his/her conclusion based on hearsay; a police report is generally inadmissible in court and "their" insurance company is relying on this; 'their' insurance company based its decision on its insured's statement. These are only possible reasons...can't really say based on your post. Did you ask the insurance company why? and how exactly did the accident happen?
