I have seen an awful lot of posts recently wanting to know either how to terminate someone’s PR or from the NCP wanting to walk away from the child. There have also been replies to some post stating that they could get the NCP to terminate rights. Children are not property and you can not just walk away or give up your rights just as you can when selling a car. There are two main areas where it ‘could’ be granted by a court,

a) There is someone else to adopt the child and take on the financial responsibility of that child
b) You set up a massive trust fund to ensure that the child is financially secure until the age of majority.

A court can terminate someone’s rights under certain extreme circumstance. These include child abuse/serve neglect etc.. A judge will not terminate PR because of non payment of child support, they will instead, eventually, send that person to jail.

Yes, a court can terminate someone visitation, access or even take away any powers to have a say in the child’s upbringing, but unless ‘a’ or ‘b’ is met, then both parents will be financially responsible for the child until such time a court says otherwise.

Bottom line, laws are in place to ensure that the child is financially taken care of until their age of majority and that the child will not be a burden on the state. You can not just terminate someone rights or walk away just because you/they have not seen the child for x years or not paid child support.

Yes, there are exceptions in the law, but for 95% of the related questions posted on this board, termination of parental rights ain’t gonna happen.
