We moved out of our rental on July 2, 2004. Our landlords are a retired couple who live on a houseboat in Alaska. We have received no word on the status of our security deposit. In WA, the landlord has 14 days from the date of our moving out to return the deposit, or submit a written list of specific deductions justifying retaining some or all of the deposit. We have heard nothing until yesterday 9/12/04 when a message was left on our phone stating that due to carpet cleaning (as a result of our dog) and other, non-specified expenses, there would be deductions. The law here in WA states that if the deposit isn't refunded (partially w/ written statement, fully, or not at all w/written statement) within 14 days, they waive any legal rights to keep any of it. If we have to sue in small claims court, can we file our claim in the district where we live, or do we have to file in the district that the landlord's agent (their daughter) lives? Their agent lives across WA state from us, but the law states that the agent must reside in the same county as the rental property. Since that isn't the case, which district do we file in? The agent's or our own? Can we collect a judgement from the agent, or the landlords only? Any info would be greatly appreciated.
