Hypothetical....
A thief car-jacks a NYC cab driver. The cab driver, with a gun to his head, follows the driving directions given by his captor. Suddenly he jams on his breaks and jumps out of the car to safety. The thief also jumps out of the car which begins rolling again, as it was not put into park (who can blame the cab driver?) and collides into a car - a woman and her 2 kids. The woman sues the cab company for damages, claiming that the cab driver was negligent in jumping to safety and leaving the moving vehicle uncontrolled.

Was the cab driver negligent?

are you the cab driver or the car jacker :confused: just kidding! :D ;) since it was the cab co. property that hit the woman and her 2 kids she has a right to sue the company. the cabbie may not get in trouble b/c he was escaping danger but he DID let the car roll.
