My brother in law is retired from the Army receiving an army pension and has recently applied for SSI disability due to health problems. My question is 2 fold. He and his wife were married and divorced once during his career so there was not 10 years of consective years of marriage during his service. #1. Is she entitled to part of his military pension? and #2. Since they are not legally separated, although they have lived apart for 3 years, will she be able to claim money from his SSI in the event of a divorce?
