Hi, I am a dj in Austin, Texas and my questions are regarding dj remix use of songs. I searched the forum and found these threads:

and through them have read that since the dj creating the remix was charging for his services, he owed EMI a fee. Is it illegal for me to record a mix (off vynils I've purchased) and give it to my friends?

How is the radio allowed to play any song? i'm assuming they pay fees to the appropriet organizations and are thus granted the rights to play them.

How does djing live on the radio work? Is it the same way? I imagine since the dj is live-mixing over the radio station's equipment, it is covered in the fees that they pay?

Also, i have seen a lot of djs release their own mix cds and was wondering about the legality of these as well.

any help or direction to literature that would shed some light on this situation is helpful (i get lost in copyright law texts).

Any performance, be it live or recorded, of a copyrighted material requires either a release from the copyright holder or a license fee from either BMI or ASCAP.

A DJ, either working in a club or radio Station is an employee. The licensor is the establishment. In the case of a radio station, they pay both agencies a yearly fee for the rights to play the songs.

i'm no legal expert, but my dj friend tells me that you can make mix cd's for promotional use if no fees are taken and it is under a certain amount.
