can i use common symbol or picture as logo?

Hi....can I use a common picture as a logo. I am using Tajmahal (in India) as the logo...I currently received a letter form another business saying that I am using their logo and they are threading me to sue and forcing me to remove the sign board....what if my business use the same picture as a logo....from my point of view a common symbol or picture is for everyone not for just one individual…..could anyone give a good advice on Copyrights & Trademarks for common symbol or picture...
