date overdue

What is the name of your state? PA
I signed a contract with a company that builds prototyes, for a machine to be built. The completion date on the contract was over 5 months ago and I still haven't received the machine. I believe that the company is trying to build the machine, but I wondered...how much more time I should allow them? And - do I have any legal recourse if they fail to produce the machine?

Of course no one can answer that question as we have no idea how complex the 'machine' may be, nor what the delays are.
I would suggest you ask them in WRITING for an update and a specific schedule for completion.

And - do I have any legal recourse if they fail to produce the machine?
And again, no one can answer that without reading the FULL contract to see what rights you may, or may not, have agreed to.

Thanks for the reply. I don't want to seem impatient, but I have a lot of money invested in a machine that isn't bringing me any income. The letter seems like very good advice. I'd rather have the working machine than take any legal action anyway.

So, EXACTLY what actions have you taken in the past FIVE MONTHS to bring this to an end???

Believe it or not...we've been patient waiting for the machine to be finished. I realize that life doesn't always go as planned and things happen. After this long though, we'd like to see a happy ending for all involved. The letter seems like a good start - hopefully it'll help.

We're still waiting for the completion of our machine. As recommended; I did send a letter to the company that is building the machine. As suggested; I asked for a reply to give me a new completion date. The letter that I received in reply gave me no specific completion date - just stated that they apologized for the delay (this was the first and only apology from them), but that unforseen problems had arisen and that they would call us in a few weeks for us to see it running.
Well...it's now a year past it's original completion date on the contract, and we're still waiting. How long are we obligated to wait for them to finish it? I'm afraid that if I involve a lawyer in this that the work will stop completely, but after this long I'm wondering if it hasn't pretty much stopped anyway.
