I recently had an accident outside a BP Mini Mart. I tripped and fell due to a
crack in the sidewalk leading up to the front entrance.. The crack was about
a foot and a half long, and there was a 2 inch hole in the crack. The front of
my shoe got stuck in the hole and I tripped and fell, hitting the right side of
my head hard on the cement. I sustained a gash above my right eye which
required 5 stitches. I was taken to the hospital by the paramedics. I made
a second trip to the hospital today, October 5, 2004, due to swelling in my
hand and sever swelling of my eye.
As of today I have heard nothing from anyone at the BP Mart, even though
the person who was working at the time of the accident called the owner and
advised him that there had been an accident on his premises.
I would like to know if I have any kind of a case for negligence on the stores
part. My son and I took pictures of the crack and hole and as of today it still has not been fixed nor is there any kind of barricade by the crack to alert other customers of the crack..
