Going thru a contested divorce (pro se) and there are two automobiles (new) that are being contested. I have been paying on them both, by myself for the past 9 months because they are both in my name. In the divorce, I am asking the judge to split them up, to where he gets his car back and must refinance it. The problem is he keeps getting a job and quitting it. What will the judge/court base his income on? Will they base it on his earning potential? His earning potentially is more than what I make, and is what he was making while we were married. He keeps quitting jobs, or working under the table so he is not responsible for anything. He is now unemployed. We have been refered to mediation.
Any help would be greatly appreciated it.
